IC took a break and celebrated the victory like the rest of you, however, the past corruption did not go away. Deals are still out there, documents are being shredded. A tale of the good old boy network still needs to be exposed.

We've made some recent strides behind the scenes, and opened up the proper channels to do something about it. However, we cannot do anything without the help of our valued sources. We need information now more than before, let's hold the proper people accountable and continue taking our state back.

IC cannot go into great detail, other than to say.. if you have information that we can validate? IT will get where it needs to be, pronto.

There will be many updates to come, as this site rises up again against those who would steal from you and corrupt our institutions.

Open Letter To Fellow Ron Paul Patriots:

This information was being held back for the right moment. We now believe that moment’s time has come. The intention of those controlling the hearts and minds of a large portion of the American People by blatant manipulation of the international media outlets was clear months ago. Recently the obvious nature of this manipulation has become so blatant that the time to act is upon us. What was obvious to a supporter now has reached the point that even non-supporter will be able to notice the intentional manipulation and see through the smoke and mirrors.

The purpose of this information is in no way intended to change anything you are currently doing to support Ron Paul. The grassroots efforts have been tremendous and instrumental in getting Ron Paul to the level of support he currently enjoys. By all means continue to do what you have been doing. Continue donating to the campaign and by all means continue your support on the street by passing the word about Ron Paul, the next President of the United States. Don’t forget the next big donation date just around the corner January 21, the birthday of Dr. Martin Luther King.

For over 3 months a very wealthy libertarian minded individual has been lurking among you on numerous Ron Paul websites. He has been carefully watching the media, the various state GOP organizations, the National GOP, the grassroots efforts and the various candidate forums. He has come to one conclusion; the people behind the scenes, the ones that really have the most to lose are doing everything possible to derail the Ron Paul movement and campaign. People that were compromised inside of various organizations some time ago have collected and provided a plethora of evidence and documentation to provide a clear connection between numerous candidates’ staff and media personnel to harm Ron Paul. There are memos clearly stating “official editorial opinion” inside these organizations in collusion with interested parties that violate numerous laws and certainly ethics issues. Teams of individuals have been hired by candidates to write disinformation about Ron Paul on forums, including here, to manipulate polls and to post on the social networking sites. Furthermore even one media outlet has also dedicated individuals to deal with the grassroots postings online. The rabbit hole runs deep and when you see some of the people involved you will be amazed. As a matter of fact one person is in a position of trust that will be so embarrassed they will most likely resign from their job.

All things considered some actions have been taken. The individual involved in promoting what I am about to describe is no friend of the government and has no political ties. In fact he despises the IRS to whom he has paid tens of millions of dollars for many years. He has been involved in broadcasting in the past and knows the business quite well. He therefore decided months ago to prepare for the possible contingency that he would need to step forward and provide direct public support of the one person he feels can make a much needed difference in our country and the world, Ron Paul. That time has come.

A little over a two months ago we began production of a mini-series called “Ron Paul – The Peoples President”. Part One covers everything about Ron Paul from his introduction to politics to his voting record over the years. It documents his struggle against the entrenched elite and how these individuals have duped the American people for many decades. It shows the clear bias against Ron Paul and how he has many times stood alone in the interest of the American public only to be ignored in Congress. Part Two discusses 8 major issues of utmost importance to the American People to include Healthcare, taxes, constitutional values, monetary policy, the Federal Reserve System, a sound foreign policy, loss of liberties, the war on terrorism, real social security reform; it is all covered. Part Three which is now in it final days of post production explains how the various policies by which Dr. Paul stands could be implemented and how they would benefit the American People. Each part is one hour in length and is designed to run commercial free. In addition 3 different commercial trailers have been produced to advertise in advance the “mini series” to bring the maximum number of viewers to the program. The 3 one minute production trailers are “The war in Iraq, Oil and Corporate Profiteering”, “The Personal Income Tax & Social Security – Real Answers” and last “The American Healthcare Crisis, a Real Solution.”

This production has been quietly ongoing, in a privately owned production studio for months. The production quality is everything you would expect from a Hollywood production house. To give you an example the host speaks on a set every bit as nice as the production set used by Wolf Blitzer’s Situation room, well actually nicer. I am also pleased to announce that the host is a well known actor.

The exclusion by Fox News in the forum days before the New Hampshire primary was bad enough but the complete “blackout” to follow was the final straw. In the words of the individual behind this “It is time to roll. These people have awakened a sleeping giant and they will not know what hit them.” Of course, he was referring to himself and the resources available to him to deliver the message on primetime television.

Why is this information being posted here and now? Because we know, from our inside contacts, this forum is very well watched. Actually this forum is called the “paulhive” internally to one of the media organizations. After reading this they will realize what I am typing is true and that they do in fact have a leak. Yes, gentlemen, you are soon to be exposed. So the first thing he feels this does is serve a warning to the media; you are on notice that your days of disinformation are numbered. Your corruption and illegal activities soon will be exposed. In addition there has been collaboration among the news organizations to universally drop coverage. Yes, there has been a formal agreement and policy has been passed down. This is also going to be exposed and individuals are going to be called out, by name. Secondly, he has noticed a little too much negativity building among the most important people, the grassroots. I have been asked to say this to you. “Rome was not built in a day. Now is not the time to give up hope. Now is the time to double your efforts. This is far from over. You never know who lurks among you that are with you and your efforts.”

So where do we go from here? That decision is going to be made in the next few days. It has not yet been determined when mini-series time will be purchased. It should be before the Super Tuesday states. A lot depends on the media, the GOP and a few other important television specific factors. This broadcast time is going to be very expensive and needs to be planned carefully.

The bottom line is that this will run and we will do everything possible to get the GOP nomination. If it is clear that the media and GOP will do everything possible to derail a GOP nomination then perhaps the only solution left will be to elect Ron Paul as an independent non-party President. Yes, we know Ron Paul has said that he will not run third party or independently but with the backing of a Billionaire running a 3 hour national broadcast mini-series, once if not twice perhaps even three times, to support the grassroots would be more than enough to make history by electing an Independent President. All it takes is for people to hear his message in clear understandable terms and not soundbites and the rest takes place naturally. We hope all this considered would motivate Dr. Paul to continue to carry the torch of liberty to November for all of us regardless of the GOP nomination. They can have him as a Republican President or an Independent; the choice is now theirs. One thing is absolutely certain, he will have a voice until November when he returns the White House to the people.

Keep your heads up and keep doing what you can. Donate money, donate your time and keep spreading the word about our next President, Dr. Ron Paul. Support is critical at this time. Just remember, you never know who lurks around you.

A few months ago channel 13 went after a gas pump inspector in Madison county for not inspecting gasoline pumps while he was struggling with cancer and chemotherapy. Hoosiers who think Detroit, Michigan has problems better think twice.

Indianapolis, Indiana has a major problem that’s hurling downward like a meteorite, destroying everything in its path. Don’t be fooled with Indiana Black Expo and the Coca-Cola Classic “wez black folk all happy” fluffery. That’s just annual economic development for Downtown Indianapolis, Inc.-- and black businesses in Indiana are NOT at the table. These “kum ba yas” double as way to give funds to “pet” not-for-profit organizations controlled by crooked black legislators and their girlfriends/boyfriends, friends & relatives, offering relatively nothing of marketable value in return. These funds are usually to “Celebrate Diversity” without having to “really” do anything for blacks. You see, our black politicians have sold OUR rights to opportunities in the City of Indianapolis in exchange for their social and political platforms and slush-funds, these not-for-profit organizations.

Speaking of crooked politicians, now these SAME not-for-profits can now be certified as a disadvantaged human being as a “protected class”. That’s the same class that allows government to have set-aside programs for women and certain minorities. Yes, an “Entity” in Indiana, can be a “protected class”, but not really--just in Indiana. Which reminds me, our black legislators should at least have a high school education? They’ll comprehend law better.

Yes an “Entity” can now win a contract over a black man or black women to take advantage of set-aside money. I wonder of a women or minority can use this same “protected class” status to take advantage of all those GRANTS that not-for-profits can apply for? NO, of course not

Most corporate diversity initiatives, (funds) it’s always about the dollars, are focused on the old-school “something for nuthin” concept. This was introduced during a time in Indianapolis black history when our ‘black militant leaders” were demanding things because they felt white America owed reparations, and they convinced our white leaders that “they” would collect on behalf of the black men, women and children. To this date, there are hundreds of women-owned and black businesses across Indiana that could provide services and perhaps more focused and positive exposure in our communities.

Yet, instead of contracting with these women and minority owned businesses, corporate America and our government is GIVING money to these not-for-profits who continue to ENTERTAIN tens of thousands of black folks each year during Black Expo and the Classic, while increasing the burden on tax payers—while year after year the economic and social status in the black community declines. Concerts don’t educate, Tavis Smiley and Sinbad speaking for 50 minutes I a large auditorium talking about his life, does educate, dance contest, galas, don’t educate. We are spending too much money that is intended for the minority community on ENTERTAINMENT.

There are MANY wonderful not-for-profits who get very little, like the Martin “Sickle Cell” Center on 35th College. They really need some funding.

We must stop bypassing legitimate black businesses that offer more than just a corporate luncheon for $2000 a table and a banner, but who offer actual products or services in return. Black businesses in the city of Indianapolis have received only a paltry 1-3 percent of city contracting 12-14% less than the commitment. Shameful.

SO WHAT GIVES IN BLACK INDIANAPOLIS?

Running government is HARD--maintaining race-relations is even HARDER, especially in a city with a growing black population.

Indianapolis politics is involved in a power struggle between the black controlled city-county council/7th congressional district and its citizens. While the citizens left government to monitor itself they NOW realize the candidates that were subsequently elected do no possess the qualities necessary to lead our city and many have been involved in questionable conduct.

In our absence, over the years officials from both parties, in order to deal with the growing influential black voter, decided to make THEIR lives simpler and more predictable by just “agreeing behind closed doors” WHO would be Congressperson, WHO would be Mayor, WHO would be Judge, WHO would be on the CCC. Even future positions have already been negotiated, behind closed doors!

Under this system, the black person usually selected lacked formal education and was unable to get crossover votes--assuring they would never get uppity and run for Mayor or the Senate. A congressperson “should” also posses the necessary intellect and communication skills to be Mayor or a US Senator, otherwise they SHOULD NOT be in our nations capitol speaking on Hoosiers behalf, black OR white. Thus, under this system we acquired our set of black legislators. Not from the cream rising to the top, but back door deals with antiquated white party people and “dumb” black legislators.

This is the WORST type of racism ever played on black people in Indianapolis!

Indianapolis 101: Conservatives Must Save The Circle City Or Fall Like Detroit by Akindele Akinyemi

I had a very long and intense conversation with my sister Attorney Darla Y. Williams last night. She was giving be a lesson how her home town of Indianapolis is about to be turned into another Detroit. Now that is scary to me because I remember stopping through the Circle City on my way to Nashville many times and I can remember how nice the city looked.

Those days are long gone.

Attorney Williams explained how the city has gone from a respectable form of government to a more liberal style of government. Of course, I have said many times that when you allow liberals to run your city I guarantee you they will run it in the ground with overspending, socialist ideologies, failed public education, and raising your taxes to the extent of where you have an outstanding foreclosure rate that is astronomical.

Let's take this clown for instance. This is Monroe Gray. He is the City-County Council president (Indianapolis and Marion County are running an consolidated government). The Democrats hold a majority on the council while the Republicans hold a minority.

This guy is in trouble because Monroe Gray received city "set-a-side" money that should have gone to women and minority contractors who are certified by the City of Indianapolis. Monroe used his position on the council to use a bogus concrete company, Mid-Region Concrete, to get the contracts for himself. He hid his contracts from the public and his constituents until he was ordered to disclose them once the media found out about it. We must vote ALL of the democrats out of the city offices. They are stealing opportunities from women and minority businesses for themselves, their families and political cronies.

This damn near sounds like Former City Councilman Lonnie Bates here in Detroit.

When Republican members of the Indianapolis City-County Council said they might launch a renewed drive to open an ethics probe of council President Monroe Gray the council president (Gray), relying on procedural rules, effectively managed to shelve a proposal calling for an investigation into his business dealings at a council meeting three nights ago.

The broader investigation could include questions about Gray’s $83,000-per-year Indianapolis Fire Department job as political liaison to the council on which he sits.

This Democratic Councilman, Ron Gibson, struck a police officer last year. will run his bid for re-election to the City-County Council next month without the criminal case that has dogged him for the past year. A special prosecutor Wednesday dismissed misdemeanor charges accusing Gibson of shoving a police officer outside a bar in July 2006 during Indiana Black Expo’s Summer Celebration.

And it does not stop there at the city level. Wait until you see two of the state lawmakers who represent Indianapolis.

Like Bill Crawford. Here is a man who never finished high school and is a state representative. His HB 1566 is a bill that will (1) help mandate detailed record keeping, and (2) mandate a statistical analysis to better monitor (and help regulators enforce) minority business participation efforts.

The reality is this. Representative Crawford introduced legislation that allows the casinos, the universities, and all government agencies to no longer have to contract with minority businesses and instead can give to the not-for-profit companies he is affiliated with or controls such as Indiana Black Expo, the Concerned Clergy, and the Indianapolis Black Chamber Commerce. The bill expands the definition of "minority business enterprise" to include nonprofit corporations.

The bill was signed into law by Gov. Mitch Daniels.

Crawford, a former drunk Black Panther is always talking black, pimps the black community and speaking that nationalist BS. When he ran the Indiana Black Expo, he helped to bankrupt it while he was president and did not account for the funds. This sounds familiar with some of the foolishness here in Detroit. I keep saying over and over again this has nothing to do with Democrats and Republicans. This is a war on our values here in Detroit and every single urban area in Michigan. When Gov. Granholm signed into law to raise our taxes we should have been on the phone, on the Internet, etc. (as URBAN CONSERVATIVES) figuring out what was our next move in 2008 will be in terms of supporting our candidates who will support our agenda.

Furthermore, how does that bill that Crawford supports help women minority owners in Indianapolis?

But the next person I am about to bring up on the witness stand is the worst State Senator I have ever heard, seen or witnessed. Even worse than former State Sen. Henry Stallings from Detroit.

This is Sen. Glenn Howard (D) of Indianapolis. He had a pea shake (racketeering) busted in Indianapolis. He cried to the Indianapolis Star for writing the “biggest lie ever told” about his being involved in a recent pea shake raid.

“I don’t mind people lie, but don’t lie,” he said. He was on the scene thanking local residents for cleaning up drug problems, and when the raid happened, he was just asking what happened. “I’m in the paper because I talked to the police, and encouraged kids to get off the streets.” Seniors have a nice Thanksgiving thanks to pea shake houses. “I don’t know nuthin’ about gambling .... I don’t know nuthin’ ’bout none of this,” he said, noting that when he goes with senior citizens to Las Vegas, “I play golf.” “If I go lose five dollars, I’m through.” He continued, “If someone want to do somethin’, now that’s their business.” Sen. Howard added, “This is what people want to do, that’s their business. We’ve got to stop meddling in their business.” “If I want to gamble, that’s my business,” and he seemed to hint, in closing, that police were hypocritical because they shake down the pea house proprietors at Christmas time for money for the toy funds they maintain for underprivileged kids."

I have never heard ANY State Senator in recent times talk as ignorant as this one. Not even Sen. Irma Clark-Coleman from Detroit. At least she can articulate her positions.

Senator Glenn Howard was once reminded, by a lawyer whom he defamed, that he was a "Senator" and should behave like one. His angry response was "I ain't no Goddamn Senator, I'm a nigga! The lawyer replied, "That may very well be, but your constituents have a right to know this."

And I cannot leave out the Ghetto Mafia's Queen on the Throne: Congresswoman Julia Carson.

It was her crew that tore down a park for toddlers and young children to build an exclusive parking lot for a tavern/bar.

For example, the wife of City-County Council President Monroe Gray, Teresa Gray is an investor in the bar. Then there's Lacy Johnson, the father who's been hiding behind his son's namesake, who is Julia Carson's long-time political campaign manager and partner at Ice Miller. And Joyce Rogers, who is Indiana Black Expo President.

Now Congresswoman Carson, who is part of the Democratic Congressional Black Caucus, has not finished school herself!!! This is a federal legislator that has taken so many people to hell in Indianapolis. Ask Julia how many college credit hours she has earned. If anyone had sense you would check her background.

Over the years her credentials have changed, but are not verifiable. No one has questioned her about her background. Julia have pimped the community and taxpayers long enough. Julia Carson used employees at the Trustee office to sign and mail in over 200 post cards to the Indianapolis Star to be named woman of the year. What the hell is that all about?

And this is Congresswoman Carolyn Cheeks Kilpatrick's friend and homie in the CBC!!!! Where is the integrity?

It will take conservatives like us to help our colleagues in Indianapolis to overcome liberalism. I hate to see Indianapolis turn into a Democratic wasteland. The city is coming off their first Super Bowl win. I would personally like to see Eric Dickerson run against Juila Carson for Congress again. Eric Dickerson is a Black Republican in Indianapolis.

We know our constituents are upset everywhere with the Democratic Party in urban areas across America. They are really upset with them here in every single urban area in Michigan as well as Indianapolis. An approval rating of 11% is criminal with the Democratic Leadership in Congress. Here in Michigan, the next state representative races in 2008 will determine if conservatives have the juice to balance power in the Michigan House of Representatives. I KNOW for a fact that we cannot wait for the RNC to give Black Republicans help in terms of campaigning. This will be OUR job to make that happen.

Let the RNC and their affiliates follow OUR lead for once. If we do not save our inner cities soon places like Indianapolis will end up like Detroit.

"ATLANTA -- The commissioner of Atlanta's Department of Watershed Management made a plea for conservation today because of the severe drought that has forced restrictions on 61 counties in north Georgia. Robert J. Hunter called it a drought "of historic magnitude." He said everyone must come together to protect and conserve limited water resources. The storage for Atlanta's water supply is Lake Lanier, located north of the city. Hunter said it provides water for one-third of the residents of Georgia. He said that now there is enough water in Lanier to serve the area for 121 days. Hunter joined Atlanta Mayor Shirley Franklin at a news conference at City Hall to urge citizens in Atlanta and the surrounding area to do everything possible to conserve water.VIDEO: Lake Lanier May Run Out Of Water Soon
The 61 counties were placed under Drought Restriction Level Four on September 28 by the director of the Georgia Environmental Protection Division, which essentially is a ban on all outdoor watering. Hunter said a level four is called "exceptional, which is beyond extreme." Both Hunter and Franklin strongly endorsed better use of water in the home, such as having a plumber check for leaks. Franklin said the city is steadily making improvements on an outdated city water system, averaging about 700 repaired leaks a month."

Well LPD Chief Grandy and his DC Lance seem to have Kimber .45's. These are $1200 pistols. Well you see , MCSD bought Kimber pistols a couple years ago to "try out". Swat got them and the hack supervisors. So someone needs to check with the city comptroller to see if all the weapons from MCSD are accounted for. IMPD has been trying to get this info but MCSD has yet to provide it. Hmmmm, also Grandy had made a change to the LPD policy of carrying locked and cocked .45's. It was not allowed previously, and is only allowed for off duty carry now. But they both wear them on duty in uniform. But Grandy will write some up for the simplest of infractions.
So are these tax payer funded guns that were never turned in?? And they could not have been "retirement" gifts. The reason, because no taxes were paid on these pistols. They have to be sent back to the seller and then re-sold.

Ok, here is a link to see what 2006 assessments are.

His address is 163 W Thompson Rd. He has this enourmous garage that was built in 05. Prior to that being built he added on to the house. I wonder if he pulled permits. I looked on the County's website and it showed no permits ever being pulled for his home. His house has new siding and is landscaped very nice. I do not know his sq ft but I believe he has a 3br home w/ a dinning room. My home is a 2br, 1ba, living room, kithcen, and NO dinning room. The sq ft of my home is 765 and the basement which isn't finished is 765. I have the OLD aluminum siding and until this past March I had little landscaping. I have a tiny one car garage and there isn't anything special about my property. If you were to look at both properties you would consider his much nicer than mine and most in the neighborhood. The home on the east side of him is no where near as nice but it has a 2 car garge and I would assume close to the same sq ft but his assessed value is still lower. To my knowledge he has lived here for a long time.

When the new tax assessments came out I looked up his and he only went up $5k to $67k. My assessment went up $12k to $74k. BULLCRAP!!!! His house should have hit atleast (at least) $85K in opinion. I know the housing market and I would consider myself knowledgeable enough to know what a home is worth. I buy homes, live in them for a while why I fix them up and sell them. He has to have some hand in what his property value is.

Also, something else to look into. If our tax $ purchased his BRAND NEW Police Packedge Dodge Charger. If our tax money didn't pay for it then our tax money has at least paid for the plates. He has official police plates on the car. I tried asking around about this and was told all constables must provide their own cars but the twp will plate them for them. If that is the case then you can bet he avoided sales tax which would have been $1800 and up. Chargers are about $30k + for that trim package.

Oh, one more thing..........I would LOVE to know what these elected officials make. I was told by a few retired officers that they make $100K + for part time work

We the tax paying citizens of Indianapolis DEMAND to know why Joe Billerman was allowed to use company and tax payer funded busses to display his candidacy during the Labor Day Parade? Mr Billerman had his picture and campaign items posted on the front window of the city bus, as well as multiple additional locations.

This is an outrage, and we demand immediate action. So you know, this message will also be presented to local law enforcement, the mayors office, CCC, the Indy Star, and every blog out there.

Take action, we will not allow our money to be illegally wasted in this manner. There are multiple witnesses to this offense, and we are willing to provide proof. Why Billerman himself, at the beginning of the parade route, told an employee that he KNEW this was illegal. Rather than STOP, and REMOVE the items, he chose to continue on. Knowing full well that his actions were breaking the law, this is the person who's running for our CCC? This is the financial manager of your Indy Go operation?

If Mr. Billerman has any character at all, he will tell you the truth when asked about this. If not, then we will be happy to come forward and sign any appropriate document validating our claim.

Dealing with the homeless issue

Okay, so IC doesn't normally comment on issues outside of corruption. However, something HAS to be done about these clowns. Saturday LS took a 10 mile bike ride at around 9:00 in the morning to stake out our placement for the parade. I got to Washington Street by the government center when it began, an African American in his 30's on what was more than likely a stolen bike blocked my path on the sidewalk. "Hey man, brother to brother, pimp to pimp?" I said nothing, and rode around him. "Oh, it's like THAT then?" Sorry, have a nice day and good luck. I turned down by the cinema entrance to Circle Center, where, within two blocks, just about the SAME shit twice more. Finally I made it to monument circle and then over to Pennsylvania Street to take my place. After trying to keep down my hot dog after listening to the blatant rhetoric from the likes of Joan Carter, Bling bling, and having watched Ballard throw in the towel, I decided to head back over to the U Bon Pain and have a sammich, and some tea.

4 times within 30 minutes I was approached looking for smokes, money, and leered at. Parked on the street were three LEO IMPD officers, and one Cumberland cop. They had some good conversation, and I went over to let them know my thoughts. Apparently the ACLU has jumped in over the crack down and thrown a wrench into trying to clean this crap up, look, we are compassionate to a point and would help someone down on their luck, even give them the shirt off of my back if it would do some good. LS has volunteered at the homeless shelter more than once, and even on holidays. However, this is more of a sub culture than it is getting upset with the needy folks who have mental issues, or no hope for a meaningful job at their age.

No, what LS saw down on the circle was a group of young kids who looked highly strung out on drugs. About 10 of them took over the Chocolate Factories tables out front, then "no joke" proceeded to pass a joint around with the LEO's not more than 10-15 feet from them watching the construction happening for the concert Thursday night. Having observed that, LS thought back to the days of our youth, then went in and got an ice cream cone to stay longer and watch the show. 10 minutes later, one of the young girls came over and told me that she was hungry. I just told her that I would not do her any good, and that drugs are bad for you. She flipped me off and went back over there with the rest who then leered at me. Hey, LS can take care of myself, and this and the construction interested me enough to sit there a while longer and at least eat our ice cream before riding home.

Well, 5 minutes or less later. Here comes another one. One this time, he tried to hand me a flyer telling me god loves me, and if I came to church he would buy me a cup of coffee? I let him know that I was in fat not homeless, poor, or in need of finding my way and thanked him for leaving me alone. No sooner had he walked away, when another kid came out of no where with his hand real high up in the air like I was supposed to "High Five" him? Now this kid looked like trouble, I gave him a stern look and said. "I do not know you, nor am I going to shake your hand. I am not going to give you anything, now leave while I enjoy my ice cream or I will paint your ass up and down the sidewalk!" He called me a mf'er, and something else, then went over to the other kids.

What in the hell has our down town turned into? I went into the Chocolate Factory and complained, but it was nothing but kids in there. I went back over the now 6-7 LEO's standing there and just vented a little, then mentioned some of the blogs to them and rode off into the sunset.

I don't have a solution off the top of my head for the problem we're facing down there, but I can tell you this much. With the suits from the NFL in town this week, and Bart's desire to host a Super Bowl. That isn't going to happen if any of them happen to take a walk around what's supposed to be the center peace of our city, rather, like anyone with common sense, they will get the hell out of here as quickly as possible.

That Parade on Sunday was a joke

LS took the opportunity to ride on down there on the bike, then hang out up close to the however our battery for the digital camera went out early.

Things we observed:

Bart Peterson had NO voice, he could hardly whisper when he got up on stage. He was hardly audible, and must have had his hose turned on a lot recently. IC thinks he heard footsteps, more on that later, it's pretty interesting.

Who is the guy with Indy Go with the beginning name of Joe "something last name?" We ask as his employees had illegally posted his pictures on the front window of the bus, and we have witnesses. IC thinks we need to make light of this, but can't remember his last name. Anyone?

Okay, so Andre was there pressing the flesh. Frank was the master of ceremonies, he got up there and mush mouthed something out that we could not discern.

Then there was Julia, her Black 300 came up with the folks up at the mic trying to get the crowd to chant "We love Julia" one of two people half assed that. "chuckle" Now, IC does not know if she was into the ripple that early in the morning, or if she has just gotten that bad health wise. But, she could not get herself out of the car, make it on stage, or even stand up on her own. Literally three people helped her out of the car, while two others held her up while the 3rd held the mic. LS is not kidding, she mush mouthed a couple of labor this labor that, then she said something that really shocked us. "They need to come up there and put some of us in jail" WHAT? Not kidding at all, she said that clear as day. If you haven't seen the youtube we posted on here not that long ago, look it up a couple of weeks past, she is worse than that now.

Oddest thing of the day happened when the final truck in the parade came out. It was a red Ford, and it had "Greg Ballard" on the side of it. The crowd had all but left by this point, but there he was. Walking behind the truck with a couple of people and pressing the flesh for all he had. A lot of people were happy to see him, at least those that were there. LS followed him on the bike, he went one block and was done. It was both funny and sad at the same time, this guy IMO needs more support or we are going to get much of the same.

MEMORANDUM
Subject: Washington Township IFD Consolidation
Date: July 11, 2006

I have preliminary reviewed the issues surrounding the pending consolidation of the Washington Township Fire Department with IFD into the consolidated city fire department. I have identified three issues that could affect the validity of the pending action.

1. Did the township comply with the notice requirements of the applicable statute?
2. Was there a quorum of the township board present when the township resolution was approved?
3. Can members of the City Council who are firefighters cast a vote on the consolidation resolution?
4. Is the statute on consolidation constitutional?

The first issue is whether the township board complied with the requirements of 1C 36-3-1-6.1, specifically subsection (g) of that statute. That statute says:
A township legislative body, after approval by the township trustee, may adopt a resolution approving the consolidation .... A township legislative body may adopt a resolution under this subsection only after the township legislative body has held a public hearing concerning the proposed consolidation. The township legislative body shall hold such hearing not earlier than thirty (30) days after the date the resolution was introduced.
The facts, as I understand them, are that the township contends that a public hearing held in August of 2005 on a resolution that had been introduced, but not approved by the township trustee, constitutes a public hearing under this statute and that a hearing held a few days after the Trustee had approved a substantially different resolution did not have to be subject to another public hearing. There also seems to be some uncertainty at this point whether or not the initial public hearing or the meeting at which the resolution was adopted were properly called and advertised.

It seems to me the clear intention of the statute is that the public hearing will be held on the resolution that is to be adopted; not on some general resolution on consolidation. If a required hearing was not held and advertised as required by statute, then the actions of the Board in acting on the resolution would be void.
The second issue is whether there was a quorum present at the meeting at which the resolution was adopted and whether that meeting itself was properly advertised. As of the writing of this memorandum, we have not determined whether or not the proper notice was given of that meeting. As I understand the facts, the board meeting was held with only four members present. One of those members was the president of the board who stated during the meeting that she had moved the prior week, but also made some comment to the fact that she did not intend to move her residence until the end of June.
The statute on township boards in Marion County clearly states that the seat becomes vacant when the board member no longer resides in the district. The question will be whether or not the moving of her furniture and her family to another location does, in fact, change her residence. There are really two factors involved in this. The first is the fact that the Evan Bayh case suggests that residence may be a matter of intention, not physical presence. However, the statute does suggest some indications of residence, which would seem, perhaps, to be violated by the actions taken by the president of the board.
Third, there is a question whether or not a firefighter may vote on the consolidation resolution if, in fact, that occurs. There are two issues in that respect.

The first is whether the City Code providing for disqualification of council members on mattes of conflict would be violated by a councilor not abstaining on the issue. The provisions of the Code dealing with that matter are in Section 151-152(b). It would seem to me that the criteria set forth for making the decision, which clearly indicate that four of the five considerations would argue in favor of disqualification. It is hard to believe that a member of the fire department or a member of the family of a firefighter could state that the interest did not affect their independence of judgment. Certainly, the public would not believe that the councilor was voting in a disinterested manner. There seems little need for a particular subject matter knowledge in determining this issue. Undeniably the adoption of the consolidation would have a unique, direct and material affect on the councilor's non-legislative income. It is important to note that subsection (c) of that section requires that the interest of the councilor be challenged by motion to disqualify the councilor prior to the announcement of the vote being taken.

There is a second subsidiary issue of whether or not the statute that allows employees of the city, particularly officers of the police and fire department, may sit on the council is constitutional. The statute that permits that has not been challenged, although the language of the statute would seem to be contrary to a prior Court of Appeals decision on that matter.

Fourth, there may be questions about whether or not the provisions in the consolidation statute are itself constitutional. It is clear that this section on consolidation of fire services is a special statute applicable only to consolidated cities as is stated in subsection (a) of the consolidation section. Under the Supreme Court decision in the South Bend annexation case, there could be an argument made that this is not a proper classification.

A more serious question may be raised about whether or not this provides for the implication of the imposition of special taxes perhaps on persons not receiving the service. The statute fails to provide a separate taxing district for the consolidated city fire department. It makes some inconsistent statements in subsection (h) about the imposition of taxes. While it states that the consolidated city may levy taxes within the consolidated city's permissible tax rate, but that levy limit applies to the consolidated city, which is the county less the excluded cities. Then it goes on to say that "however these taxes may be levied only within the fire special services district and any townships that have a consolidated fire department under this section." Does this mean that the City-County Council could levy a tax separate from the FSSD rate on property in Washington Township? have been involved in the determination of how property taxes are levied and assessed in the consolidated city for at least thirty-six of the thirty-eight years that those taxes have been assessed, and I have no idea how one would determine how the property tax limits apply to the levying of taxes for the payment of the expenses of the consolidated fire department under this section.

MONTICELLO -- In the coming months, Bob Fox will spend time working with troubled, at-risk youth and will help encourage businesses to come to the city.

It will be part of the 200 hours of community service the 71-year-old ousted mayor must perform after pleading guilty Wednesday to four counts of Class D felony theft.

His subsequent sentence to three years probation in White Superior Court stems from an 11-week investigation this spring into allegations that Fox was reimbursed mileage claims for trips he never took.

"Judge, I hope I have the right words. Number one, I'm extremely ashamed," Fox said before a packed courtroom. "I want to apologize to the citizens of this great city of Monticello, Indiana, which I love very much and would do anything for."

IC would also like to know how it is that, our public representitive on the water board declined to vote on the recomendation to use United Water? U.S. Rep. Julia Carson's grandson has declared his candidacy for the City-County Council seat vacated on Saturday by Patrice Abduallah.

Andre D. Carson filed paperwork with the clerk's office on Monday. On his organization statement, Carson listed as his secretary a frequent poster on local blog sites, Wilson Allen.

Abduallah resigned the District 15 seat after admitting that the address he put on his candidate form was just outside his district. The deadline for filing as a candidate is Friday. Democratic party precinct captains are expected to choose a new council member in a caucus vote on Aug. 28. So far, Carson is the only declared candidate.

He could not be immediately reached for comment.

IC wanted to take a moment this morning and weigh in on the current arrest of the "phantom" beat down at the Black Expo that's currently taking over the local news.

IC has to wonder about a few of things here:

1) What does Bart have on our prosecutor?
2) Why would former cons carry any weight with Sheriff "bling bling?"
3) Do they really think this will do anything but piss all of us off further?

One thing that IC was happy to see was Sullivan and the FOP coming out in officer Chappell's defense.

IC just got off the phone with our favorite mole, and the amount of information we were provided with is over whelming. It's going to take most of the week to sort it all out, verify the information, then start getting it out there. We're not going to completely tip our hand, and we gave you some reference, or a pretty big hint to a small part of it today. We now have in our possession actual proof, but it has to be sorted and validated. We will not post anything until this is done, documents need to be copied and then secured, tapes reviewed, videos verified, and a lot of phone calls made.

We also have to be very careful and not disclose our identity in getting this out there, as people who find themselves in desperate situations, well, there will be a lot of them... can always try to come back for revenge.

IC wants to make one thing perfectly clear, we are not affiliated with any political party, nor do we have an ax to grind against any particular party. The only thing we want, is for the corruption to stop at all levels, and for the parties responsible to be held accountable. It is time for all of us as citizens to hold those who are elected to represent us responsible for their actions, no longer can we afford to sit back while others profit from lying, cheating, and back door deals. Rules and public law are not just for us working stiffs, and tax paying folks. And that's what several members of our current representation are about to find out, the hard way.

East Cleveland

How the mayor of this Cleveland suburb became entangled
in a nationwide corruption scandal is among the most bizarre
tales in the annals of water privatization.

At age 22, Emmanuel Onunwor left Nigeria in hopes of
finding a fresh start in the United States. Fifteen years later,
in 1997, he became the first African-born mayor in U.S.
history. His improbable success story ended in disgrace in
September 2005, when Onunwor was sentenced to nine
years in federal prison after being convicted of receiving
bribes, kickbacks and secret payoffs.

CH2M Hill, received a 3-year, $3.9 million contract to run
the city’s water and sewer system in 2002. OMI, then a
subsidiary of CH2M Hill, handled the contract. But instead
of going through a bidding process, federal prosecutors say
the company won the contract by bribing Onunwor through
a series of intermediaries – including a front company that
worked for CH2M Hill.101 The ringleader (who did not
work for CH2M Hill) was later convicted on 36 federal
charges related to bribing officials in East Cleveland,
Cleveland, Houston and New Orleans102 (see “The Big
Sleazy”).

The OMI contract was doomed even before Onunwor’s
fall. In March 2004, the corporation said it was pulling out because the city
– which had been in a state of fiscal emergency since 1988 – owed it $5.1
million. City officials criticized OMI for giving them little warning and
presenting flawed financial projections abandon a contract that you have determined is tainted by scandalous activity, poorly serves the financial interest of
your community, and has given rise to an appearance of
misfeasance in the use of public funds.”

But that was just the beginning. The same city official and
Veolia employee who worked together to tailor the contract
for Veolia were convicted of stealing more than $300,000
from the city by submitting phony invoices and intercepting
reimbursement checks. The official was sentenced to 18
months in prison; the Veolia employee received five years’
probation.107,108

And there’s more. A city auditor found that $77,000
in questionable charges from the sewer plant was
billed to the city, including parties, clothing, gift
cards and Christmas trees.109
In the end, the city and Veolia wound up suing
each other in federal court – the city
claiming Veolia owes it $1.6 million,
and the corporation alleging the
contract was improperly cancelled.
“The whole situation is really unfortunate,”
a Veolia spokesperson
said. “Our company does so many
wonderful things."

The Big Sleazy

New Orleans

In a city where corruption is akin to business as usual, efforts
to privatize both the water and sewer systems in New
Orleans have been stung by bribery scandals.
The latest scheme was masterminded by a politically connected
engineering executive, Gilbert Jackson, who was
linked to a four-city corruption ring that also entangled the
mayor of East Cleveland, who himself is serving a lengthy
prison sentence in part because of a water privatization
scandal. "reference coming"

In January 2006, Jackson admitted he accepted $19,500
from a lobbyist representing Severn Trent, a multi-billiondollar
British company vying to win a contract to operate
New Orleans water and sewer system in the late 1990s. At
the time, Jackson’s company was advising the city’s Sewerage
and Water Board on how to structure the privatization
plan. He was sentenced to six years and ten months in
prison following his conviction on nine federal corruption
charges. The federal probe also ensnared numerous public
officials and business figures in East Cleveland, Cleveland
and Houston.

Not even the local media was shocked. “So now we learn
that, even before the board was considering privatization,
the process was corrupted to the point of illegality,” the
Times-Picayune wrote. “Is anyone out there surprised?”

New Orleans dropped its privatization plans in 2004, after
five years and $5.7 million worth of study. The 20-year, $1.5
billion contract would have been the largest ever awarded
in the U.S. It fizzled after city residents and the state legislature
overwhelmingly approved measures giving voters the
power to approve or reject any privatization contract worth
more than $5 million.

Both Suez and Veolia cited the measures as reasons they
withdrew their bids. “If we now have to run an election
every time we want to get a job,” a Suez executive said, “it
makes public-private partnerships cost-prohibitive.”

A few years before the water and sewer scheme was
hatched, bribes began flowing to help another private company
keep its contract to operate two of the city’s sewage
treatment plants.

The president of Professional Services Group (PSG) (which
was implicated but not charged in a corruption scandal in
Bridgeport, CT) was convicted and imprisoned for bribing a
Sewerage and Water Board member in hopes of extending
PSG’s contract in the mid-1990s. The board member was
also convicted and jailed. PSG’s parent company, Aqua Alliance,
pleaded guilty and paid a $3 million fine. Veolia,
which was not implicated, began investing in Aqua Alliance
in 1990 and owned a majority share by 1997.

When Chaos Meets Corruption, Atlanta

Atlanta
By the time it was all over, it wasn’t even front-page news.
Atlantans had to turn to page 2D on March 4, 2003, to read
that their City Council ended its 20-year relationship with
Suez subsidiary United Water 16 years early. This is not to
say it wasn’t big news. Maybe journalists were just tired of
writing about it.

New Year’s Day, 1999 marked the beginning of the largest
water privatization in U.S. history – a $428 million deal
that United Water promised would cut Atlanta’s water costs
in half. Everything would improve: repairs, maintenance,
billing, customer service, emergency response – you name
it. “Atlanta for us will be a reference worldwide,” Suez’s
Chair Gérard Mestrallet said at the time, “a kind of showcase.”

It was also Suez’s coming-out party in the U.S. Eight
months later Suez announced its purchase of United Water,
the nation’s second-largest water company, elevating its
strategic alliance to an all-out merger.

Two years into the deal, the U.S. Conference of Mayors
bestowed Atlanta and United Water with its Outstanding
Achievement Award, remarking the deal “exemplifies the
type of corporate citizenship that makes cities stronger and
healthier.”

Clearly, the mayor’s organization spoke too soon.
Only 18 months later, in August 2002, the city was so fed
up with United Water’s poor performance that it threatened
to terminate the contract if the corporation didn’t turn
things around within 90 days. Due in part to dramatic staff
cuts, maintenance backlogs were “unacceptable,” repairs
were delayed, and responses to emergencies were “consistently
and habitually inadequate and potentially hazardous.”
The city was losing millions of dollars because United
Water wasn’t reading, installing and maintaining water
meters frequently enough, nor was it collecting enough late
bills.

The city accused United Water of submitting bills for work
it didn’t do – even working on other contracts and trying to
win new contracts while on Atlanta’s dime. And the company
refused to release certain billing records.

Scandal broke two months later when former Mayor Bill
Campbell, who had signed the original deal, announced he
never signed documents authorizing $80 million in extra
payments United Water had requested. Though the public
knew Campbell was under investigation at the time, few
knew what would follow.

After a lengthy probe, Campbell was charged in 2004 with
multiple federal corruption charges, including accepting
$12,900 from United Water to pay for a trip to Paris with a
female companion, and taking United’s $6,900 campaign
contribution at a time he was not eligible for re-election.

At Campbell’s trial in early 2006, it was suggested that
one of Campbell’s top aides may have forged the letters.
Campbell was convicted of tax evasion in March 2006, but
acquitted of racketeering and bribery. He is currently awaiting
sentencing.

United Water was not charged.
It was not corruption, though, that doomed United Water,
but the corporation’s performance. Only half of the expected
savings were realized. Fire hydrants were repaired
at half the speed required. And a backlog of 14,000 work
orders had amassed.49 Still, a week after Atlanta officials announced
plans to cancel the contract, a privatization advocate
with the libertarian Reason Foundation said, “It’s still
the model. Just do everything completely opposite of what
Atlanta did.” It is hard to see how that would be an argument
for other cities to follow suit.

Three weeks after Atlanta rescinded the contract, which
United Water called “amicable,” CEO Michael Chesser left
the company after just 15 months on the job. Atlanta officials
didn’t view the termination this way. The City Council
rejected United Water’s proposal for a gag order forbidding
Council members from discussing the final negotiations. “I
am not going to bite my tongue,” said Council member Felicia
Moore.

Corruption

1994-2003: Bridgeport, Connecticut – Former Bridgeport Mayor Joseph P. Ganim was
sentenced to nine years in prison for corruption on several counts, which included a relationship between his office and Professional Services Group (PSG), which was purchased by US Filter. A major part of the testimony heard was regarding two multi-million dollar sewage contracts awarded to PSG – first a five-year contract, then an extended 20-year contract – in return for $500,000 in kickbacks from the company through consulting fees and benefits.

1997-2003: New Orleans – Again in New Orleans, USFilter has had to deal with controversy
over contracts. This time a corruption scandal involving the bribery of a former New Orleans
Sewerage & Water Board member in order to rig the renewal of a contract to run the city’s two
wastewater treatment plants. Katherine Maraldo, the former Board member was convicted of
accepting bribes during the mid-1990s from Professional Services Group (PSG) president
Michael Stump. Stump, who was president of the company at the time, was buying Maraldo’s
support for a five-year extension of the company’s contract to run two wastewater plants. At the time Maraldo was the chair of the committee that oversaw the contract. Stump was convicted in June 2003. The contracts are now held by Veolia Water North America, formerly USFilter. Both Maraldo and Stump were given jail terms. At the time of the crime, PSG was a unit of Vivendi’s indirect US subsidiary, Aqua Alliance.

1996-2001: Houston, Texas – In May 2001, PSG, a subsidiary of Aqua Alliance, reached a plea
agreement with the US Department of Justice in which Aqua Alliance pleaded guilty to a charge
of bribery and was fined $3 million. The plea was in connection with allegations that members of the Houston City Council received illegal contributions from PSG consultants. At that time,
there was a battle over the proposed privatization of Houston’s wastewater facilities, and PSG's
lobbying team was drenching city officials with cash inducements.

2000: Milan, Italy – The Italian newspaper La Republica revealed in early 2000 that a senior
manager at Vivendi planned to bribe Milan politicians in both the majority and opposition parties on Milan city council in order to win the tender for a Lira 200 billion (~$100 million US) wastewater treatment plant. Evidence includes a floppy disk with a letter to Vivendi’s partners from Vivendi executive Alain Metz, which contained information on the deal and implicated Vivendi executive Massimo De Carolis. Maetz wrote how he has excellent contacts with the Polo delle Liberta, the right wing majority coalition (whose leader was media tycoon Silvio Berlusconi, and who is now Italy’s Prime Minister) and planned to pay Lira 4 billion (~$2 million US) in bribes to Italian politicians. As well, Maetz wrote how Coge, a company 40% owned by Berlusconi’s brother, should become a partner with Vivendi in this bid, though “as a matter of security”, his brother should sell his stake in Coge before the tender.

1997: France – In 1997 Jean-Michel Boucheron, the former mayor of Angouleme was convicted
and sentenced to two years in prison for taking bribes from companies bidding for public tenders. This included $55,000 for a fictitious job by General des Eaux in exchange for giving the Vivendi subsidiary a water distribution contract in Angouleme.

1989-1996: France – The construction units of Bouygues, Suez and Vivendi have all been the
subject of a major judicial investigation over allegations that they participated in a corrupt cartel
where they shared contracts for the building of schools in Paris to the exclusion of other
bidders.

Problem contracts and controversies:

2005: Gabon – The Gabon energy and Water Company (SEEG), which is 51% owned by Veolia,
was reprimanded by the Gabonese Government in early 2005. The Government blamed SEEG
for recent water shortages in the capital city accusing the company of not wanting to invest in the short, medium or long for the production, transport and distribution of water.82 To deflect criticism SEEG purchased a full-page advertisement in the government newspaper L’Union to offer apologies and claim that service had almost returned to normal.

2004: Lee, Massachusetts – After 4 years of lobbying by Veolia Water North America, town
representatives of Lee, Massachusetts voted 41-10 against granting the corporation a 20 year
contract to run the municipality’s public water and wastewater systems. Community organizers
waged a successful campaign against the privatization of the essential services, raising doubts
about the company’s promise that current employees would keep their jobs.83 Resistance to
privatization in a small community like Lee is a good example of how large multinationals are
vulnerable to well organized and persistent action.

1996-2004: Angleton, Texas – The City of Angelton terminated its contract with Veolia Water North America, saying that the company did not provide the promised level of service. The company had been running the city’s wastewater treatment plant and maintaining the city’s streets since 1996. Since the contract was terminated, the city and Veolia Water North America have been embroiled in a number of lawsuits.

2002 – 2004: Indianapolis, Indiana – Indianapolis authorities are realizing the mistake they made when they bought a 130-year old water utility from NiSource in 2002 and handed it over to US Filter instead of keeping it a public utility. Since US Filter was awarded the contract, lawsuits have been filed and customer complaints have gone up by 250% for the water utility, which serves over 1 million.

Within one month of requesting management proposals, US Filter was granted a contract. Opponents criticized the excessive secrecy and “fast-tracking” surrounding the agreement. At its first opportunity, the company, limited by the contract from firing employees in the first two years, began to cut corners by slashing employee benefits. A report by Public Citizen, member of the Indianapolis Citizen’s Water Coalition, states that “non-union employees lost their valuable "defined benefit" pension; health care coverage was reduced, vacation time, personal days, sick days and holidays were all reduced. The employees claim that over $9000 in annual benefits have been lost or $4.3 million per year. Employees are angry and fearful as talk of the first layoffs in 130 years circulate. CEO Jim Keene told employees, ‘Being fair does not mean having a job for life’.” The employees have brought a federal lawsuit against the City charging breach of contract.

A second lawsuit against the City was filed in April 2003 by three local taxpayers challenging the
legality of the contract. They claim that the City ignored the law by establishing the Department of Waterworks to oversee the water utility without the permission of the Department of Public Utility

– an Indiana State law ensures that any new utilities in the county must fall under the supervision of the local public utility office. They also claim that the Citizens Gas & Coke Utility would have been in a better position to manage it as a public water utility. Since taking control, net income of the utility has dropped 19% and revenue has dropped 25%. The founding member of the Indianapolis Board of Waterworks, who wrote a letter to the media condemning the 2002
purchase, quit after the Board passed a resolution limiting its members from speaking with the
media regarding the utility.

In the summer of 2002, almost 16,000 customers were over-billed by successive computer
glitches by the US Filter-owned billing company.

Recently, US Filter’s decision to cut back on fire hydrant testing was made public when frozen fire hydrants prevented the control of a fire, which engulfed several buildings.

The Indianapolis Star noted that the company was taking steps to repair the damage it had caused – “Apparently unaccustomed to working with community groups,
USFilter convened a citizen’s advisory group, as is required by its agreement with the city, but
had no members with experience in water utility or environmental matters”.

2003: Poughkeepsie, NY – Repeated failures of US Filter to remedy the foul odours coming from the water treatment plant they operate have prompted City officials to look elsewhere for potential bidders when the contract expires in 2005. The plant has had to be shut down several times over the last year during special events. US Filter has said it plans to bid for the contract again.

1998-2004: Rockland, Massachusetts – In February 2004, the town of Rockland Massachusetts
terminated its 10 year $1.2 million contract with US Filter to run the town’s sewage treatment
plant on the advice of the state Office of the Inspector General. The Inspector General
determined in 1998 that the contract was tailored to US Filter to the exclusion of other bidders. Rockland Town Administrator Bradley Plante sent a letter to Veolia Water North America President Michael Stark stating that there was “clear evidence that indicates collusion between former superintendent Gregory Thomson and US Filter Regional District Manager Sause which resulted in a violation of the competitive bidding process”.

The termination of the contract came on the heels of an audit of the town’s sewer department,
which found widespread misuse of town money at the plant. The audit detailed about $77,000 in
fraudulent invoices charged to the town between 1998 and 2002.92 To make matters worse, when the contract ended, Veolia Water North America allegedly helped themselves to a large amount of equipment without paying the city. Town officials say the company should pay $1.6 million for what they allegedly took.

In September 2004, Gregory Thompson pleaded guilty to charges of embezzlement and was ordered to pay back the $336,000 he admitted stealing from the town. Thompson said that he and Michael Sause, a district manager for US Filter, submitted phony invoices to the company and intercepted reimbursement checks. According to Thompson, the two also stole funds US Filter had reimbursed to the town from wage, equipment, maintenance, and electricity accounts. Sause is accused of working with Thompson to steal over $160,000.

1999-2004: New Orleans – In August 2004, five years and $5.7 million later, the Sewerage &
Water Board of New Orleans ended its flirtation with privatization. Throughout the 5 year
process of consultations and studies, US Filter remained one of the top potential bidders for a
$1.5 billion contract to run New Orleans’ water and sewer systems. The initial bidding process by Suez’ United Water and US Filter, now Veolia Water North America, was voted down in October 2002 after heated public opposition. The drive to privatize was revived in January 2003, but only one bid from US Filter was put forward raising fears that the city would not get a competitive price for the contract.

There were also persistent rumours that US Filter may have had an ‘inside track’ for the contract.
There was speculation that US Filter was confident that they would be awarded the contract so
they ‘stuck around’ for the revived privatization drive in 2003. This confidence is believed to come from the company’s efforts to hire consultants close to Mayor Ray Nagin and Eddie Sapir, the City Councilman who serves on the water board and spearheaded the privatization drive.

Lawrence - The Lawrence Township trustee accused of paying his rent with public money heads to court Monday.

Michael Hobbs allegedly asked the Castleton Volunteer Fire Department to make a $500 donation to a charity. Prosecutors say Hobbs used the check to pay his rent at the Park Harrison Apartments.

If convicted Hobbs faces a six-year sentence and a $20,000 fine.

IC doesn't know where to start today? After picking up the local fish wrap, then reading how these pinheads think that hospitals and churches = property tax reform. We lurked on over to some of our other favorite blogs to discover that we're the proud owners of 4k trash cans now, and some folks arguing over who broke the Patrice fiasco. Not to be discouraged, we turned our attention to another area.

IC operatives have been attending a lot of meetings recently, in particular, most of what you can see on channel 16. We're tweaking our list down now, and narrowing in on those who would do us harm as citizens with corruption.

One thing that has really stood out to us has to be the general lack of accountability in general, and we think that lack of over sight, lends itself to the problems that we are facing now. In particular, the lack of participation by other concerned citizens. While we're working on many leads, and putting together broad evidence, we cannot do this by ourselves.

People have to wake up and get off your asses, get involved, speak up, and be heard. Unless you do this, nothing we can do will help you. We're not preaching, just stating the simple truth. Too many of our fellow citizens have no clue about what is happening around them, and this indifference has led to the problem that we have now. Yes, the property tax issue woke a lot of people up. But, we need to be diligent in our stewardship of the people who are supposed to be there to represent us. We have failed, but all is not lost.

IC wants to put out a general call to arms, take an hour out of your day and find out who represents you in your area. Discuss your concerns with them, tell them what your issues are. Let them know that you are watching, let them know that you will hold them accountable. Other wise, you get what you deserve.

IC has learned through reliable sources that in fact, the CCB has been bringing in HVAC and Carpentry people in through the basement. As a matter of fact, if you look to the Indy Star classifieds, you will see these positions advertised in open media.

What this current administration has got to begin to realize is there is no place to lie and hide any more, our fingers are all over this city. Bart Peterson called for an immediate hiring freeze, and announced that in the national media. IC wants to know who came up with the idea at the City County Building to end around their boss, or if he even knows what actually occurs in his own administration?

In particular, some might take a hard look at the 23rd floor and wonder who the paid consultants are, and what their purpose is? But IC digresses, we would have to know what a line item on the budget "Other" with 300% spending increases represents? Maybe we could fill in those 5 blank pages on the budget from last year with this information?

As always, we are active and aware, and working hard on new pending items for later next week. We just wanted to make sure you know that we haven't taken our eye off the ball in the process. Leads continue to come in to us daily, some of them are better than others. But we encourage any of you who want to share, to email indycorrupt@yahoo.com

IC has gone to great pains to start researching some far reaching corruption in our local government, our moles are meeting, our crack staff is researching, and what we're coming up with is beyond comprehension. I wish that we could offer more on this right now, however, it will be no earlier than late next week to put all of this together. In the end, our hope is a long line of orange jump suits. IC can say this much, if we used just the information we have now, we could easily unite some resources and bring some of them down. However, we want them all, not just the small fish and we have to be iron clad in our fact presentation.

So you'll have to wait while we work it out, as soon as we can release some information to you, we will.

So some folks apparently took it a little far with some of the comments, IC sent a couple of email messages into the show. The first one asked if was only going to lob Bart soft balls today, then offered him a couple of questions.

1) How many deputy Mayors does the mayor require?

IC sent him one more, then sat back and listened to him "Amos" stew about it while Bart was on there. I guess quiet a few must have taken up the cause, as he was very agitated and said we were the black on black haters? Huh? IC is not a black man, or a cop, just wanted him to ask some reasonable questions of the Mayor.

2) The second email we sent asked him, because he said "the mayor did" that he had made a mistake not getting out in front of the people. Why he refuses to go on the Garrison show?

Congrats to everyone who emailed, and pissed him off! Of course they immediately turned this into a race issue, someone must have sent him a question wanting to know if the mayor had seen the "Bart Lies" t-shirts and bumper stickers. He keeps babbling on about some monkey photo?? Can someone tell me about that?

Is he talking about the Minority report, and bartlies??

STATEMENT OF THE CASE

Appellant-Defendant, Maurice Davis (Davis), appeals his conviction for possession of cocaine with intent to deliver, a Class A felony, Ind. Code § 35-48-4-1.

We affirm.

ISSUES

Davis raises two issues on appeal, which we restate as follows:

1. Whether the trial court properly admitted Indianapolis Police Department Drug Task Force Sergeant Steven Kinkade’s testimony into evidence; and

2. Whether the State presented sufficient evidence to support his conviction for possession of cocaine with the intent to deliver.

FACTS AND PROCEDURAL HISTORY

On June 28, 2001, Indianapolis Narcotics Detective Steven Gorgiveski (Detective Gorgiveski) and Indianapolis Police Department Officers Ball, Brannon, and Campbell worked a special detail in the area of Broadway and College Avenue in Indianapolis, Indiana due to a high number of complaints for gambling and narcotic sales. Specifically, Detective Gorgiveski and Officer Ball responded to a report of narcotic sales on Broadway near 30^th Street.

When Detective Gorgiveski and Officers Ball, Brannon, and Campbell arrived at a house located at 3048 Broadway, they observed a group of six or seven people drinking. After watching the subjects bend or crouch down for a while, the officers also believed that they were gambling. Detective Gorgiveski and Officer Ball approached the group of people, while Officers Campbell and Brannon positioned themselves behind the car. At this time, Davis stood up and the officers heard the dice hit the ground. Davis also dropped two clear plastic baggies, containing a substance suspected to be cocaine, and a bottled water. Additionally, there was an assortment of U.S. currency on the ground near the two plastic baggies of cocaine, bottled water, and dice.

As a result, Detective Gorgiveski arrested Davis. Davis advised Detective Gorgiveski that the contraband did not belong to him and that he was on probation. The evidence, i.e., cocaine, money, and bottled water, was photographed. Eventually, the suspected cocaine was transported to the narcotics vault. After stipulation from both parties, the substance was identified as cocaine, with a total weight of 5.6225 grams.

On June 29, 2001, the State filed an information against Davis charging him with Count I, possession of cocaine with intent to deliver, a Class A felony, I.C. § 35-48-4-1, and Count II, possession of cocaine, a Class C felony, I.C. § 35-48-4-6. On September 5, 2002, Davis waived his right to trial by jury. On September 9, 2002, a bench trial was held. The trial court found Davis guilty as charged and merged Count II into Count I for sentencing. On October 25, 2002, Davis was sentenced to the Indiana Department of Correction for a period of forty years.

Davis now appeals. Additional facts will be provided as necessary.

DISCUSSION AND DECISION

Admissibility of Sergeant Kinkade’s Testimony

Davis argues that the trial court erred by admitting Kinkade’s testimony into evidence. Specifically, Davis maintains that Kinkade was not a qualified expert witness under Indiana Evidence Rule 702. Therefore, Davis asserts that the trial court erred by allowing Kinkade to express his opinion as to Davis’ thinking or intent with respect to the cocaine.

The admission of evidence is within the sound discretion of the trial court. Simmons v. State, 760 N.E.2d 1154, 1158 (Ind. Ct. App. 2002). The decision whether to admit evidence will not be reversed absent a showing of manifest abuse of the trial court’s discretion resulting in the denial of a fair trial. Id.; Spires v. State, 670 N.E.2d 1313, 1315 (Ind. Ct. App. 1996). In determining the admissibility of evidence, the reviewing court will only consider the evidence in favor of the trial court’s ruling and unrefuted evidence in the defendant’s favor. Simmons, 760 N.E.2d at 1158.

In the instant case, we find that the trial court properly overruled Davis’ objection to Kinkade’s testimony. Here, Kinkade testified as a “skilled” witness rather than an “expert” witness. A “skilled” witness is defined as “a person with a degree of knowledge short of that sufficient to be declared an expert under Indiana Rule of Evidence 702, but somewhat beyond that possessed by the ordinary jurors.” O’Neal v. State, 716 N.E.2d 82, 88-9 (Ind. Ct. App. 1999).¹

Under Ind. Evid. R. 701, a skilled witness may testify to an opinion or inference that is:

rationally based on the witness’s perception, and

helpful to a clear understanding of the witness’s testimony or the determination of a fact in issue.

Haycraft, 760 N.E.2d at 211. The requirement that the opinion be “rationally based” on perception simply means that the opinion must be one that a reasonable person could normally form from the perceived facts. Id.; Hanson v. State, 704 N.E.2d 152, 155 (Ind. Ct. App. 1999). The requirement that the opinion be “helpful” means, in part, that the testimony gives substance to facts, which are difficult to articulate. Id.

Here, the State developed a foundation to establish Kinkade’s qualifications to testify about Davis’ possession of cocaine with intent to deliver. At the time of Davis’ trial, Kinkade had been with the Indianapolis Police Department for sixteen years. During his sixteen years on the force, six and one-half years were spent specifically on investigating narcotics crimes. In fact, Kinkade was the detective in charge of the North District Narcotics Unit. He received special training in narcotics that included schooling for the detection and affects of ecstasy, methamphetamine, cocaine, marijuana, and club drugs. Further, Kinkade was involved in approximately 600–700 narcotics investigations, the majority of which involved cocaine. Moreover, the record shows that the trial court overruled Davis’ objection to Kinkade’s testimony because, “it is relating to the types of investigations he has been in …the training he has received and the years of experience all relay to me the conclusion that he is capable of forming an opinion as to what someone with the quantity package and that weight would intend to do with it….” (Transcript p. 33). Given this background, we find that Kinkade was sufficiently qualified to testify as a skilled witness. See O’Neal, 716 N.E.2d at 88-9; Haycraft, 760 N.E.2d at 211.

Further, Kinkade testified that his opinions and inferences were based on his personal experience as an investigator; thus, his testimony was rationally based on his perception. His testimony was helpful in determining the issue of intent to deliver because Kinkade established the distinct characteristics that differentiate between a drug user and a drug dealer. Specifically, Kinkade testified that drug users generally do not have large amounts of drugs on them. He stated that usually drug users buy $10 to $20 “rocks” of cocaine that weigh approximately .10 grams and immediately smoke it. (Tr. pp. 31, 33, 35). Conversely, the record reflects that Kinkade testified that drug dealers generally carry larger amounts of cocaine on them.

In this case, Davis discarded two plastic baggies of cocaine, each containing an “eight ball” or approximately forty-five rocks of cocaine that were individually wrapped or “bindled.” (Tr. pp. 34). Kinkade concluded from his training and experience that the cocaine was packaged for dealing because it was uncommon for a drug user to carry the amount of cocaine that Davis possessed. The record also indicates that no paraphernalia used to smoke cocaine was found on Davis or near the scene. Clearly, Kinkade’s testimony gave substance to facts that were otherwise difficult to articulate. In particular, Kinkade’s testimony was helpful to determine the intent element of the charge for possession of cocaine with intent to deliver. As such, we find that the trial court did not abuse its discretion in admitting Kinkade’s testimony as a skilled witness. See Simmons, 760 N.E.2d at 1158; Haycraft, 760 N.E.2d at 211.

II. Sufficiency of the Evidence

Davis contends that the State failed to present sufficient evidence to support his conviction. Specifically, he argues that the State failed to establish that he possessed cocaine with the intent to deliver.

Our standard of review for sufficiency claims is well settled. In reviewing sufficiency of the evidence claims, this court does not reweigh the evidence or assess the credibility of witnesses. Cox v. State, 774 N.E.2d 1025, 1028-29 (Ind. Ct. App. 2002). We consider only the evidence most favorable to the judgment, together with all reasonable and logical inferences that can be drawn therefrom. Alspach v. State, 755 N.E.2d 209, 210 (Ind. Ct. App. 2001), trans. denied. The conviction will be affirmed if there is substantial evidence of probative value to support the conclusion of the trier of fact. Cox, 774 N.E.2d at 1028-29. A judgment may be sustained based on circumstantial evidence alone if that circumstantial evidence supports a reasonable inference of guilt. Maul v. State, 731 N.E.2d 438, 439 (Ind. 2000).

Indiana Code Section 35-48-4-1(a)(2)(C)(b)(1), in pertinent part, states:

A person who possesses, with intent to deliver cocaine, a narcotic drug, or methamphetamine, pure or adulterated, classified in schedule I or II; commits dealing in cocaine, a narcotic drug, or methamphetamine, a Class A felony if the amount of the drug involved weighs three (3) grams or more.

Therefore, to convict Davis for possession of cocaine with intent to deliver, a Class A felony, the State was required to prove beyond a reasonable doubt that Davis possessed cocaine in an amount greater than three grams with intent to deliver it. See I.C. § 35-48-4-1(a)(2)(C)(b)(1).

In the present case, the record reveals that Detective Gorgiveski and Officers Ball, Brannon and Campbell responded to complaints for gambling and narcotic sales in an area near Broadway and College Avenue. Detective Gorgiveski and Officers Ball, Brannon, and Campbell saw Davis drop two plastic baggies containing cocaine. Thereafter, Davis was arrested for possessing approximately 5.6225 grams of crack cocaine with intent to deliver. “Circumstantial evidence showing possession with intent to deliver may support a conviction. Possessing a large amount of a narcotic substance is circumstantial evidence of intent to deliver. The more narcotics a person possesses, the stronger the inference that he intended to deliver it and not consume it personally.” Love v. State, 741 N.E.2d 789, 792 (Ind. Ct. App. 2001) quoting Berry v. State, 574 N.E.2d 960, 963 (Ind. Ct. App. 1991) (citations omitted), trans. denied.

Here, the evidence on the record shows that Davis intended to deliver the cocaine he possessed. Intent, being a mental state, can only be established by considering the behavior of the relevant actor, the surrounding circumstances, and the reasonable inferences to be drawn from them. See Love, 741 N.E.2d at 792. As stated above, Kinkade’s testimony distinguished the general characteristics of drug users and drug dealers. Specifically, Kinkade testified that drug users generally possess a $10 to $20 rock that weighs approximately .10 grams. However, Kinkade stated that drug dealers typically carry relatively large amounts of cocaine including large numbers of rocks. In the instant case, Davis possessed more than three grams of cocaine. He possessed 5.6225 grams of cocaine. According to Kinkade’s testimony, this amount is consistent with an amount possessed by a dealer, rather than for strictly personal use. Further, the cocaine was individually wrapped in forty-five bindles, creating the inference that the cocaine was packaged for sale rather than for personal use. Evidence of the illegal possession of a relatively large quantity of drugs is sufficient to sustain a conviction for possession with intent to deliver. Hazzard v. State, 642 N.E.2d 1368, 1369 (Ind. 1994). Due to the amount of cocaine that Davis possessed compared to the amount a drug user would typically use, and the fact that the rocks were individually wrapped, we find that the State presented sufficient evidence to sustain Davis’ conviction for possession of cocaine with intent to deliver. See Love, 741 N.E.2d at 792; I.C. § 35-48-4-1(a)(2)(C)(b)(1).

With the above in mind, we reject Davis’ invitation to reweigh the evidence. It is the trier-of-fact’s prerogative to weigh the credibility of the witnesses and to weigh the evidence. Stephenson v. State, 742 N.E.2d 463, 499 (Ind. 2001). Because there is substantial evidence of probative value supporting Davis’ convictions, we will not reverse the conclusion of the trier of fact. See Cox, 774 N.E.2d at 1028-29.

CONCLUSION

Based on the foregoing, we conclude that the trial court committed no error in allowing Kinkade’s testimony as a skilled witness. See Simmons, 760 N.E.2d at 1158. Further, we conclude that Davis was properly convicted of possession of cocaine with intent to deliver as a Class A felony. See Cox, 774 N.E.2d at 1028-29.

Affirmed.

Randall Fugate appeals the revocation of his probation.
We affirm.
The facts favorable to the judgment are that Fugate was convicted of reckless homicide for his involvement in stealing a car and participating in a high-speed police chase that ended in the death of a police officer. The court sentenced Fugate to eight years' imprisonment, suspended two years, and ordered that the suspended portion of the sentence be served on probation. Over a ten-month period while on probation, Fugate 1) was arrested for public intoxication, 2) was charged with possession of alcohol, 3) was arrested for disorderly conduct, 4) failed to attend court-ordered, substance-abuse counseling, and 5) went to Arizona without receiving permission to leave Indiana from his parole officer. After a hearing, the court revoked Fugate's probation.
Applying the relevant standard of review, see Braxton v. State, 651 N.E.2d 268, 270 (Ind. 1995), we conclude that the trial court did not err in revoking Fugate's probation.
Having scrutinized the record for errors of law, appellant's counsel admits that the revocation of Fugate's probation in the instant case was unassailable. Our review of the record confirms counsel's candid assessment. The trial court adhered to all relevant procedural requirements in reaching its decision, and the evidence was more than sufficient to support revocation. We perceive no value in engaging in what would amount to an exercise in futility, i.e., concocting, discussing, and ultimately rejecting possible errors where it is obvious that none exist.
Judgment affirmed.

This morning IC brought up a possible conflict of interest to 1430 when Mathew Tully was on there, after some back peddling from him, I think something may have been set in motion. I'll get more specific about this later on, I have some research to do right now.

Please let me know if you can add anything on him that we should post, as you have read, we're well aware of his drinking issues and the suspension as a result of them. IC would have to have a couple of belts to sit behind Gray and pull his strings every time he wants to open his gaping maw.

IC might have a lead on some other items as well, we will see what pans out from that.

From the Indy Star today: We are trying to keep up with the corruption, but it is hard work.

Lawrence Township Trustee Mike Hobbs was charged today with two felonies on accusations he used fire department money to pay his rent.

Marion County prosecutors filed one count of theft and one count of official misconduct against Hobbs. Both are Class D felonies carrying maximum penalties of three years in prison and a $10,000 fine upon conviction.

Hobbs, 25, obtained a check for $500 from the Castleton Volunteer Fire Department and represented it as a charitable contribution, according to a probable cause affidavit filed in Marion Superior Court. The check, made payable to "Park Harrison," was given by Hobbs to Park Harrison Apartment Complex in February to pay his rent, the affidavit says.

In the check's memo portion, the affidavit says, someone wrote "Lawrence Township Historical Society."

Reached at his office this afternoon, Hobbs said he would call back and quickly hung up. A warrant has been issued for his arrest on $10,000 bond.

Hobbs told an investigator he saw nothing wrong with using the check that way at the time, but said "it does look bad," according the affidavit. Hobbs said Lawrence Township Fire Department Chief Brian Wisehart and an assistant chief, both signatories on the Castleton department's account, gave him the check but didn't know it would be used to pay rent.

"He is a public official. He's entrusted with fund and entrusted with the idea that he is going to handle those funds responsibly," said Barbara Crawford, the prosecutor's chief charging deputy.

In Indiana, elected officials immediately lose their position if they are convicted of a felony. Hobbs, a Democrat, began serving as trustee in January. He previously served in Iraq as a U.S. Marine.

In June, Hobbs was arrested and charged with operating a vehicle while intoxicated, a misdemeanor. That charge still is pending in Marion Superior Court.

Crawford said the charging process was handled normally in the new case after an investigation by Indiana State Police. Prosecutor Carl Brizzi is a Republican.

If an installment of an assessment is not paid when due, the real property is subject to the same rate of interest and penalty as is provided by statute for delinquent taxes. If an installment or assessment is not paid in the amount and at the time when due, the board shall prepare, certify, and file with the auditor of the county in which the real property assessed is located the amount of the assessment against the real property with the default in payment.
(b) The county auditor shall place the amount, together with interest and penalty, upon the tax duplicate to be collected as state and county taxes are collected at the next date for the semiannual payment of taxes. If the assessment, interest, and penalty are not paid at that time, the real property is subject to sale as is provided by statute for the sale of real property on which there are delinquent taxes. Upon the sale the proceeds shall be prorated equally among the assessment and any delinquent taxes. A sale for a delinquent tax or delinquent assessment does not extinguish the assessment.

IC just got off the phone with the Marion County Treasures office, the gal who answered the phone would not give me her name. "lol" Guess I must not have been the first person to call and request information about this.

Here is what she told me:

At any point, if you are delinquent paying your property taxes, your house can be put up for a sheriffs sale. She then back tracked and said you had to be behind one year, then she said one and a half years delinquent. So, if you haven't paid the first installment of last years property taxes, by the second due date this year, your home would be considered for a Sheriff's sale. However, when IC asked her if there were any written law online to review, she stated that it's the sole discretion of the Sheriff's department on which homes action will be taken on.

Now I want you to think about this one real hard here, how many of our CCC members haven't paid property taxes since last year?

IC has had a rough week, but not as bad as this pinhead.

"City-County Councilman Patrice Abduallah said he plans to resign his seat today after critics hounded him about whether he moved out of the district he represents.

Abduallah, 61, a Democrat elected in the 15th District in 2003, said he made an honest mistake when he listed his mother's home as his residence in council records and on his 2007 candidate forms.

His mother's house, where he is living while rehabbing his own house, is on the west side of the 1100 block of North Warman Avenue in the Haughville area. That puts the home in District 14, represented by Republican Marilyn Pfisterer.

"If it was on the other side of the street, it wouldn't be a problem,'' Abduallah said. "This technicality has cost me my council seat, and I'm upset about it. This situation is a tremendous blow to me."

Local Internet blogs have simmered recently with accusations that Abduallah moved out of his district. In an interview with The Indianapolis Star late Wednesday, he said Democratic Party officials asked him to resign.

Abduallah said it's a shame that pressure from the blogs and the media, rather than his constituents, led Democratic Party leaders to question his residency.

Marion County Democratic Party Chairman Michael O'Connor said he will hold a news conference this morning to address the situation. He said Wednesday evening that he did not know about Abduallah's decision to resign. O'Connor said he couldn't speculate on replacing Abduallah until today.

Deputy Mayor Steve Campbell said past case law indicates Abduallah's recent votes on the council will not be in jeopardy because of his residency status.

"Case law is pretty clear (that Abduallah's residency problem) won't overturn his votes," Campbell said. "It's not the first time it's happened in the history of legislatures.''

But Tom John, the county GOP chairman, said Abduallah's declaration of residency on his candidate form in January raises a host of questions. While stated residency can be difficult to challenge, John said the signed form with an address outside the district makes the case different.

"It's either sloppy or arrogant to not check if your stated address is in your district,'' Tom said. "Either way, he left the residents of District 15 without representation.''

John said council votes since January could be questioned and that Democrats may have lost their chance to name his replacement because of legal time limits.

The home Abduallah previously listed on his candidate and council forms was in the 900 block of North Sheffield Avenue, which is in the 15th District. Abduallah said he has been fighting for months with city inspection officials over the permits he needs to complete the rehab work. He said the city has stopped work 13 times.

While that work ran into city roadblocks, Abduallah said he has run into serious financial problems that kept him from paying his property taxes last year and again on Friday. Treasurer records show he owes $1,084 in taxes on his house on Sheffield.

"I'm delinquent on those taxes,'' Abduallah said. "I've really been going through some financial hardship recently."

He said the rehab work has been "a nightmare," but he recognizes that someone who decides how to spend tax money must also pay it.

"I'm going to pay my fair share because that's how we run the country," he said.

Abduallah said he didn't see any reason to fight to hold on to his seat until after the election because he doesn't want to misrepresent the district. He said Democratic officials want him to resign as soon as possible.

"I don't have an opportunity to correct my mistake," he said.

"It's bad for my family and community. But I'll live on for another day. I'll go out with grace, so maybe I can come back to the council later."

As noted by kolehardfacts on November 2nd of that year, there was a press release from the Libertarian Party which said the following:

"While reviewing the campaign finance report of Patrice Abduallah (Democrat seeking the City-County Council District 15 seat) that was filed with the Marion County Election board Oct. 17, we noted a donation of $3,450 made to Mr. Abduallah on Sept. 13 by the Greater Indianapolis Progress Committee (GIPC)."

"This donation is inappropriate for the following reasons: "

"GIPC is a 501c3 corporation. All corporations are limited by Indiana law to giving no more than $2,000 combined in a calendar year to all candidates who are seeking local offices. Mr. Abduallah received almost 1½ times that amount."

"Quoting the GIPC’s own website, 'Funding for (GIPC) Action Grants comes from application fees paid to the city by businesses requesting tax abatement.' Most importantly, we believe that some of those public funds may have been used to help fund Mr. Abduallah’s campaign."

"Additionally, Mr. Abduallah’s campaign finance report indicates that there is $755 in cash missing from his campaign fund between April and October. It also lists the repayment of a loan for $500 when no loan has ever been listed in his report."

Was Abduallah delinquent on his property taxes that year, too? Could that explain the $755 discrepancy? Or the $500 'repayment'? Just wondering... If he can't pay his property taxes, he's evidently got money problems.

Abduallah later explained his 'error' (regarding the campaign contribution) by claiming the contribution really same from the "Greater Islamic Progress Committee." Remarkable that the only two references to this organization, in ALL of the billions of webpages indexed by Google, appear in two articles referencing Abdullah's statement. Well there are now three, including this one.

Per Curiam

Lawyer Aaron E. Haith was convicted twice of operating a motor vehicle while intoxicated and convicted once of operating a vehicle with a blood alcohol content of at least .10 percent. Today we find that, by virtue of the acts underlying those convictions, he engaged in criminal acts reflecting adversely on his fitness as a lawyer in violation of the Rules of Professional Conduct for Attorneys at Law.
This attorney disciplinary case is now before us for final resolution upon the duly-appointed hearing officer’s findings of fact and conclusions of law. The respondent, pursuant to Ind.Admission and Discipline Rule 23(15), has petitioned this Court for review of the hearing officer’s findings and conclusions. Because of the respondent’s petition, our review of this matter is de novo in nature, and will involve a review of the entire record presented. Matter of Warrum, 724 N.E.2d 1097 (Ind. 2000).
We now find that on June 25, 1985, the respondent was convicted of operating a vehicle while intoxicated (OWI) in Marion Municipal Court. The incident leading to that conviction involved a motor vehicle accident that resulted in personal injury. On September 17, 1991, the respondent was convicted of operating a vehicle with .10% or more by weight of alcohol in his blood, a class C misdemeanor, in Marion Municipal Court. On September 29, 1995, the respondent was convicted of OWI, a class A misdemeanor, in Marion Municipal Court. Again, the basis for that conviction was a motor vehicle accident resulting in personal injury. After each conviction, the respondent successfully completed his sentencing requirements, including terms of probation, to the extent ordered. The sentence for the 1991 offense included mandatory alcohol counseling. The 1995 sentence included, as terms of probation, alcohol evaluation and treatment, if necessary. To satisfy those terms, the respondent obtained short-term private substance abuse counseling. The counselor observed the respondent on six occasions between January and July 1996, and concluded that the respondent had an alcohol abuse problem and that he met the diagnostic criteria for alcohol dependency.
The respondent re-initiated contact with the counselor in January of 1999. The counselor’s most recent professional opinion is that the respondent and the community will be best served by the respondent’s abstinence from alcohol, continued professional endeavors, and aggressive outpatient therapy coupled with community-based mutual self-help participation. At hearing, the Commission’s expert witness, a medical doctor specializing in addictions, testified that he concurred with the assessment that the respondent is alcohol dependent. The hearing officer found that the respondent is alcohol dependent. The respondent disputes that finding.
The hearing officer concluded that the respondent violated Ind.Professional Conduct Rule 8.4(b) by committing the criminal acts of operating a vehicle while intoxicated and operating a vehicle with .10 percent or more by weight of alcohol in his blood. According to the hearing officer, these acts reflected adversely on the respondent’s fitness as a lawyer. The hearing officer also concluded that the Commission failed to demonstrate by clear and convincing evidence that the respondent violated Prof.Cond.R. 8.4(d), which provides that it is professional misconduct to engage in conduct that is prejudicial to the administration of justice.
In his petition for review of the hearing officer’s findings, the respondent argues that his convictions of driving while intoxicated or with illegal levels of alcohol in his blood do not reflect adversely on his fitness as a lawyer. His misconduct, he contends, must be distinguished from this Court’s prior decisions finding Prof.Cond.R. 8.4(b) violations for convictions of alcohol-related motor vehicle offenses because the acts at issue in prior cases included attendant misconduct such as failures to abide by courts’ orders of probation, the commission of other acts violative of the Rules of Professional Conduct, or offenses committed by lawyers responsible for enforcement of this state’s laws. To support his argument, the respondent relies on Matter of Oliver, 493 N.E.2d 1237 (Ind. 1986) (lawyer who was serving as special prosecutor found to have committed crime involving “moral turpitude” in violation of Code of Professional Responsibility for conviction of OWI), Matter of Martenet, 674 N.E.2d 549 (Ind. 1996) (violation of Prof.Cond.R. 8.4(b) for three convictions of OWI, the last occurring while the lawyer’s license was suspended), Matter of Welling, 715 N.E.2d 377 (Ind. 1999) (two OWI convictions and conviction of intimidation in violation of Prof.Cond.R. 8.4(b)), and Matter of Coleman, 569 N.E.2d 631 (Ind. 1991) (Prof.Cond.R. 8.4(b) violation for three OWI convictions, failure to appear at hearing after release on bond, use of client’s funds without authorization). The respondent contends that his three convictions, standing alone and without some subsequent violation of terms of probation, do not reflect adversely on his fitness as a lawyer.
We disagree. Lawyers are professionally bound to comply with and uphold the law. Ind.Admission and Discipline Rule 22. A pattern of repeated offenses, even ones of minor significance when considered separately, can indicate an indifference to legal obligation. Comment to Prof.Cond.R. 8.4. A lawyer’s multiple convictions for OWI or similar offenses may indicate a willingness to ignore the law and may damage the public’s perception of the legal profession. Welling, 715 N.E.2d at 378. Such conduct also implicates a lawyer’s fitness as one who can be trusted to keep his client’s secrets, give effective legal advice, and fulfill his obligations to the courts. Martenet, 674 N.E.2d at 550. Thus, a lawyer’s commission of OWI and similar offenses, even standing alone with no attendant misconduct, have been found to violate Prof.Cond.R. 8.4(b). Matter of Jones, 727 N.E.2d 711 (Ind. 2000) (three OWI convictions and a fourth conviction withheld on terms of probation). Further, even considered separately, the respondent’s offenses are not minor, given that two of the three involved personal injury. Accordingly, we find that the respondent violated Prof.Cond.R. 8.4(b). We adopt the hearing officer’s finding with respect to the Prof.Cond.R. 8.4(d) charge.
Having found misconduct, we now turn to the issue of proper sanction. Relevant to this determination is the hearing officer’s identification of several aggravating factors. Among these are the respondent’s failure to abstain from the use of alcohol or to acknowledge his alcohol dependency and his failure voluntarily to seek long-term treatment. In mitigation, the hearing officer noted that the respondent, prior to the present action, has practiced law for 20 years with no prior disciplinary history, that he completed his criminal probation successfully, and that he generally enjoys a good reputation in the legal community. The hearing officer recommended that the respondent be suspended from the practice of law for six (6) months; that after serving one (1) month of that suspension, the respondent be conditionally reinstated and placed on probation for two (2) years; and that the respondent be fully reinstated to the practice of law upon compliance with the terms and conditions of probation. According to the hearing officer, those terms and conditions should include abstinence from alcohol use, supervision by a monitor, reporting requirements, random substance screenings, intensive out-patient treatment, and psychological evaluation and treatment.
In recent cases involving similar misconduct, pursuant to agreed resolutions this Court has imposed six month suspensions from the practice of law, with some or all of that period stayed to terms of agreed probation aimed at treating the respondents’ alcohol dependencies. See, e.g., Martenet, supra (six month suspension all stayed to aftercare), Welling, supra (six month suspension with four months conditionally stayed), Jones, supra (six month suspension conditionally stayed to period of suspension to run concurently with criminal probation). We conclude that a similar sanction is appropriate in this case as well; however, we find further that the respondent’s failure to abstain from alcohol use and his reluctance to admit his alcohol dependency warrant in this case a lengthier period of suspension stayed to stringent aftercare provisions.
It is, therefore, ordered that the respondent, Aaron E. Haith, be suspended from the practice of law in this state for a period of twelve (12) months, effective immediately. That period of suspension is conditionally stayed to a two (2) year period of probation. During that period of probation, the respondent must:
Remain free from alcohol use
Be subject to the supervision of a monitor approved by the Disciplinary Commission, with periodic meetings with the monitor who will provide regular reports to the Disciplinary Commission
Participate in an intensive out-patient treatment program approved by the Disciplinary Commission
Participate in psychological evaluation and treatment, as recommended by the out-patient treatment program
Participate in Alcoholics Anonymous or similar 12-step program
Agree to be subject to and receive random alcohol and drug screenings
Agree to a waiver of all assertions of confidentiality or privilege associated with his monitor or treating health care providers
Immediately report any noncompliance with the terms of this probation to the Disciplinary Commission
Pay all costs of compliance associated with the terms of probation.

Should the respondent violate any terms of his probation, he shall be required to serve the twelve month period of suspension which was originally stayed, at the conclusion of which he shall be required to petition this Court should he desire reinstatement. Should he successfully complete the two year period of probation, at the end of that period he shall be fully reinstated to the practice of law in this state.
The Clerk of this Court is further directed to provide notice of this order in accordance with Admis.Disc.R. 23(3)(d) and to provide the clerk of the United States Court of Appeals for the Seventh Circuit, the clerk of each of the United States District Courts in this state, and the clerks of the United States Bankruptcy Courts in this state with the last known address of respondent as reflected in the records of the Clerk.
Costs of this proceeding are assessed against the respondent.

SULLIVAN, BOEHM, and RUCKER, JJ., concur.
SHEPARD, C.J., and DICKSON, J., dissent from the sanction imposed, and would impose a sanction calling for a period of executed suspension in addition to a period of suspension stayed to aftercare provisions.

Several decades of research about healing chemically impaired people suggests that therapy is typically unsuccessful when a dependent person believes he is not. Formal analysis thus coincides with intuition: people who think treatment is unnecessary are unlikely to work very hard at it.
The present case involves a lawyer who is generally well liked and successful. But, he has had three criminal convictions for drunk driving in twelve years. His own therapist, the Commission’s medical expert, and our hearing officer have all concluded that he is alcohol dependent. He insists he is not. He also maintains that the evidence does not reflect adversely on his fitness to serve clients.
The Court says it disagrees on both points, but it sends this message so softly it seems unlikely the respondent will hear it. A short period of actual suspension seems more likely to lead to a successful result.

Old days, same as the new days!

Indianapolis may not be an exceptionally corrupt U. S. city, yet last week it found itself in a situation even more idiotic than a game of button-button-who's-got-the-button into which a rowdy player has inserted a second button. Last week, Indianapolis had four "mayors."

It all began some years ago when Indianapolis welcomed the Ku Klux Klan. The Klan brought gutter politics. Last month Mayor John L. Duvall of Indianapolis was found guilty of corrupt office-getting in his 1925 election. The City Council asked him to resign. He refused, and appointed his wife City Comptroller. In Indianapolis, the City Comptroller automatically succeeds the mayor should anything happen to him.

Last week John L. Duvall felt that something was going to happen to him, so he put his resignation in the mail. Mrs. Duvall then served as mayor—for 15 minutes—long enough to appoint a new City Comptroller and then resign herself. Her appointee was one Ira M. Holmes, lawyer.

The Duvalls and Lawyer Holmes performed this shuffling before the City Council knew what they were up to; before the Council formally ousted Mayor Duvall and named Council President Claude E. Negley as mayor pro tempore.

That evening, Mr. Duvall ordered a burly police squad to guard "Mayor" Holmes's office against invasion by "Mayor" Negley. When "Mayor" Negley arrived in the morning, he found that "Mayor" Holmes had gone out for breakfast after an early morning vigil. Mrs. Holmes sat in her husband's chair, jealously immovable. "Mayor" Negley eyed her dubiously and loitered around the office. In his pocket he had a court injunction, temporarily restraining "Mayor" Holmes from functioning.

Then "Mayor" Holmes came in from breakfast, "Mayor" Negley grinned with relief. He flourished his injunction. "Mayor" Holmes grinned. Joking, giggling, each "mayor" drew a chair up to the mayoral desk and sat down.

"Mayor" Negley made a speech. "I think I'm Mayor. I appreciate the honor the council has bestowed on me in making me Mayor for a short time. I realize the responsibility that rests on my shoulders. I realize I will not be able to handle the situation by myself. I am going to consult with the various boards. . . ."

"Mayor" Holmes strolled away and made a speech himself. "I'm Mayor of Indianapolis, but I do not propose to function or interfere in any way with Mayor Negley till 10 o'clock tomorrow. Then I'll say to him: 'Come on over and sit down, Claude.' "

Two other "mayors" of Indianapolis were one Joseph Hogue and one Walter Myers. They contended that, by Mayor Duvall's conviction, his election in 1925 was voided. Joseph Hogue claimed office on the ground that he was City Comptroller in the administration of John L. Duvall's immediate predecessor, the late Lew Shank. Walter Myers claimed office because he ran second to John L. Duvall in the 1925 election.

CITY POLICE CORRUPTION EXPOSED bannered in the Indianapolis Star on the last Sunday in February. The steamy series (60 installments are planned) has so far lived up to its billing. Among Star allegations: many officers are involved in prostitution, both as paid "protectors" and nonpaying patrons. Police shakedowns of drug pushers and users are "a way of life" in the Indianapolis underworld. Some policemen regularly traffic in stolen goods.

Such findings are the yield of six months of hard digging by three Star reporters: Bill Anderson, 48, Harley Bierce, 32, Dick Cady, 33, assisted by Photographer Jerry Clark, 34. The quartet depended heavily on clandestine meetings with over 400 informants, nearly 60 of them policemen. They tape-recorded every scrap of information. The work had its hazards: the reporters were often trailed by the police, and telephoned threats became common.

Public Shock. The story posed another kind of problem for Star Publisher Eugene C. Pulliam, 84, and his son Eugene S., 59, assistant publisher of both the Star and the Indianapolis News. For six years their conservative papers have firmly backed Republican Mayor Richard Lugar, and the exposé came just as Lugar was launching a senatorial campaign against Democratic Incumbent Birch Bayh, a Pulliam target.

The Star did hold up publication for two months so that the FBI could look into the evidence for possible federal violations. Despite the embarrassment to Lugar, the younger Pulliam decided the story could wait no longer. "It's more important," he told Star Managing Editor Bob Early, "to clean up a corrupt police department than to worry about winning an election."

As public shock at the series spread, Lugar defensively pointed out the difference between an anonymous tipster and a grand-jury witness. He said citizens had sometimes brought him charges similar to those running in the Star. "When I've asked them to testify under oath before the Marion County grand jury," he complained, "many disappear." But Lugar's problem did not. Questions about police corruption began popping up at speeches given well outside Indianapolis, and Lugar decided to deal with the issue at home. He formed a seven-man committee to study the police department, began interviewing some policemen himself. Finally, he fired the chief of police, a deputy and the city safety director. Then the mayor brought in a former Secret Service agent to clean house.

Lugar readily admits that the Star series goaded him into action. Despite the police department's success at solving homicide cases and curbing violent crime, corruption in the force has been an open Secret in Indianapolis for years. Lugar says that "in my six years we've removed ten people from the police department, and this is not an easy thing to do." The Star has made it easier for the mayor, and Assistant Publisher Pulliam thinks that the series may even boost Lugar's election chances: "It has given him name recognition he never had before."

This is a clip from a concerned wife of one of his former employees, and I don't give a flying two shits about the bank foreclosing, you know way before that and should have been honest enough to give some notice.

"My husband was a very long time, well known, and much liked employee of Payton Wells for 11 years. He was loyal until the doors closed although Payton did not return the loyalty to him or Kevin Kimbrough. I personally know that issues with payoffs and paperwork were also extremely frustrating for all who worked at the Anderson dealership since the payoffs were generated from the top with little control from below. Kevin was told abruptly to call a meeting for the staff and inform them that they had 1 hr to get their personal belongings. Those driving demos were stranded for rides, many employees could not even clean out their desks, not to mention the service area personnel were left not knowing how they would remove all of the tools and equipment that belonged to them. Employees were not permitted back on the lot after they left. The let down continues as we don't know about issues such as if our health insurance coverage is going to continue, 401 K status, etc. It has been weeks and we still don't know anything. My husband's calls have gone unreturned. He has worked very hard for 11 years to establish a large customer base, as well as a great reputation as a fair and caring dealer, and a respected member of the community. He was a high flying kite for the company and his life's string was severed without notice. He was left to the winds of uncertainty without a second thought. He will relocate, rebuild, and rebound because he is truly a high flyer destined to reach star status. I am very proud of him. I wish I could say the same for Payton Wells. I wish luck to all the former employees and hope that the community can have some relief in knowing that not all car dealers are bad or out to rip you off and that some things are beyond the control of the employee. Although there will always be shady folks in sales, most people in this business really do want to provide you a great experience and a fair price for a service that we all need- the purchase of a vehicle.
